What is a trademark?

The objects of a trademark may be words (including personal names), signs, designs, drawings, letters, symbols, figures, pictorial elements, colours, sounds, smells, the shape of goods or their packaging or any combination thereof.
– CANNOT
Creative works such as books, films, songs or theatre productions are subject to copyright protection; whereas inventions, mechanical devices, business methods and processes may be protected by a utility patent. Similarly, ideas themselves, without tangible representation, also cannot be protected by any form of intellectual property protection.

To apply for a trademark registration in Hong Kong, you will need:

  • A copy of the Business Registration Certificate (if a legal entity is applying)
  • Copy of Identity Card (if an individual)
  • Applicant’s details, including telephone number, email address and correspondence address
  • List of goods or services and type of trademark
  • A graphic representation of the trademark in digital formats such as JPG or PDF, together with the words of the trademark. The trademark must also include the specified colours (in Pantone), if applicable.

  2. Submitting your application for registration
    We will then prepare and file your trademark application with the Trademarks Registry of the Intellectual Property Department of the Intellectual Property Department of the Government of the Hong Kong Special Administrative Region.
  3. Receipt of Certificate of Registration
    If there is no opposition to your proposed trademark or the opposition has been withdrawn or decided in favour of the trademark applicant, your trademark is successfully registered and you will receive a certificate of registration.
